Terms of Service

1. Acceptance and eligibility

These Terms of Service ("Terms") govern your use of the Sotu mobile application and the sotuapp.com website (together, "Sotu" or the "Service"). Sotu is operated by Atakan Vardar, İstanbul, Türkiye. By creating an account or using Sotu you agree to these Terms.

You must be at least 13 years old to use Sotu — or older, if the law where you live sets a higher minimum age for agreeing to an online service on your own. Sotu is not directed at children under 13.

2. Your account

You sign in to Sotu with your Apple or Google account. You are responsible for the activity that happens under your account and for keeping access to your sign-in provider secure. Provide accurate profile information and don't impersonate anyone.

3. Ride at your own risk

This section matters more than any other. Sotu is a journaling and discovery tool, not a navigation or safety system.

• Road data, ratings, curve counts, "road DNA" scores, and generated loops are community-contributed or algorithmically derived. They carry no warranty of accuracy, current road condition, legality, or suitability for you, your vehicle, or the weather.
• Never operate the app while riding or driving. Interact with Sotu only when safely stopped.
• Always obey traffic law. A road being listed, rated, or recommended in Sotu is not an endorsement to ride it, or to ride it in any particular way.
• You ride and drive at your own risk. To the maximum extent permitted by law, Sotu accepts no liability for accidents, injuries, damage, fines, or losses connected to your use of the Service.

4. Your content

You keep ownership of the content you create in Sotu — rides, roads, stories, photos, canvas editions, messages, and profile details ("Content"). You grant Sotu a non-exclusive, worldwide, royalty-free license to host, store, display, and share your Content as needed to operate the Service.

Content you make public — public roads, public rides, road stories, ratings, and shares — is visible to other Sotu users and to anyone on the web: shared road pages (sotuapp.com/r/…), public ride pages (sotuapp.com/ride/…) and club invite pages (sotuapp.com/invite/…) are viewable without an account.

5. Acceptable use

Don't harass, threaten, or abuse other users; don't post unlawful, hateful, or sexually explicit content; don't scrape, reverse-engineer, or overload the Service; don't upload content you have no right to share.

Sotu has zero tolerance for objectionable content and abusive behaviour. Content that is reported and found to break these Terms is removed, and users who repeatedly break them have their accounts terminated. Report anything from the item's menu in the app or by email to hello@sotuapp.com; a person reviews every report.

Direct messages and club chats are not pre-moderated.

6. Blocking and reporting

You can block any user and report any content in the app. Blocking hides you and the blocked user from each other. A person reviews every report within 24 hours and removes anything that breaks these Terms; the account behind repeated violations is suspended or terminated. A comment or a chat message you report is hidden from you straight away, while it is reviewed.

7. Copyright and other complaints

If something on Sotu infringes your copyright, uses your trademark, impersonates you, or otherwise violates your rights, email hello@sotuapp.com with the link (or a screenshot), what the content is, and the basis of your claim. We remove infringing content promptly and will tell you what we did. Notices under Türkiye's Law No. 5651 and equivalent DMCA-style notices reach the same address.

8. Termination

You can delete your account at any time in the app (You › Settings › Delete Account). Deletion permanently removes your account and associated personal data as described in the Privacy Policy. Sotu may suspend or terminate accounts that violate these Terms.

9. Sotu Plus

Sotu is free to use. Sotu Plus is an optional paid upgrade that unlocks more features inside the app. What is free and what Plus includes is listed in the app before you buy and on sotuapp.com/plus.

• Bought through Apple. Sotu Plus is sold only as an in-app purchase on the App Store and is billed to your Apple ID. The App Store shows the price in your currency before you confirm; Apple handles payment and taxes.
• Subscriptions renew automatically. The monthly and yearly plans renew at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. Cancel any time in Settings › Sotu Plus or in your Apple ID's subscription settings; you keep Plus until the end of the period you paid for.
• Free trial. When the yearly plan comes with a free trial, nothing is charged until the trial ends, and the subscription starts automatically unless you cancel at least 24 hours before the trial ends. Apple decides who is eligible; a trial is offered once per Apple ID.
• Founding Rider is a one-time purchase, not a subscription. It includes every Plus feature for as long as Sotu operates the Service, and is limited to the number of seats shown while it is on sale.
• Refunds are handled by Apple under Apple's policies (reportaproblem.apple.com); Sotu cannot issue them directly. When a purchase is refunded, the Plus access it gave ends.
• Price changes. If a subscription price changes, Apple tells you in advance and, where the law or Apple's rules require it, asks for your agreement before the new price applies.
• What Plus includes may change as the Service evolves; changes are announced in the app before they take effect. Recording stays free, every ride you record is kept, and you can always export your own data, with or without Plus.
• Deleting your Sotu account does not cancel an App Store subscription — cancel it in your Apple ID settings as well.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, Sotu's total liability for any claim arising out of or relating to the Service is limited to the amount you paid for Sotu Plus in the twelve months before the event the claim arises from. Nothing in these Terms excludes or limits liability that the law does not allow to be excluded or limited.

11. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Mandatory consumer-protection rules of your country of residence remain unaffected.

12. Changes

These Terms may be updated as the Service evolves. Material changes will be announced in the app or on this page, and the "Last updated" date above always reflects the current version. Continued use after a change means you accept the updated Terms.

1. Kabul ve uygunluk

Bu Kullanım Koşulları ("Koşullar"), Sotu mobil uygulamasının ve sotuapp.com sitesinin (birlikte "Sotu" veya "Hizmet") kullanımını düzenler. Sotu, Atakan Vardar (İstanbul, Türkiye) tarafından işletilir. Bir hesap oluşturarak ya da Sotu'yu kullanarak bu Koşulları kabul etmiş olursun.

Sotu'yu kullanmak için en az 13 yaşında olman gerekir — yaşadığın ülkenin hukuku bir çevrimiçi hizmete kendi başına onay vermek için daha yüksek bir yaş sınırı öngörüyorsa, o sınır geçerlidir. Sotu 13 yaşından küçüklere yönelik değildir.

2. Hesabın

Sotu'ya Apple ya da Google hesabınla giriş yaparsın. Hesabın altında gerçekleşen her etkinlikten ve giriş sağlayıcına erişimini güvende tutmaktan sen sorumlusun. Profil bilgilerini doğru gir ve başkası gibi davranma.

3. Sürüş riski sana aittir

Bu bölüm hepsinden önemlidir. Sotu bir günlük ve keşif aracıdır; navigasyon ya da güvenlik sistemi değildir.

• Yol verileri, puanlar, viraj sayıları, "yol DNA'sı" skorları ve üretilen rotalar topluluk katkısıdır ya da algoritmayla türetilmiştir. Doğruluk, yolun güncel durumu, yasallık veya senin, aracının ya da hava koşullarının durumuna uygunluk konusunda hiçbir garanti vermez.
• Sürerken uygulamayı kullanma. Sotu ile yalnızca güvenli bir şekilde durduğunda etkileşime gir.
• Trafik kurallarına daima uy. Bir yolun Sotu'da listelenmesi, puanlanması ya da önerilmesi, o yolu sürmenin ya da belirli bir şekilde sürmenin onaylandığı anlamına gelmez.
• Sürüş riski sana aittir. Yasaların izin verdiği en geniş ölçüde Sotu; Hizmet'i kullanmanla bağlantılı kazalar, yaralanmalar, hasarlar, cezalar veya kayıplar için sorumluluk kabul etmez.

4. İçeriğin

Sotu'da ürettiğin içeriğin — sürüşler, yollar, hikayeler, fotoğraflar, kanvas baskıları, mesajlar ve profil bilgileri ("İçerik") — mülkiyeti sende kalır. Hizmet'i işletmek için gerektiği ölçüde İçeriğini barındırmak, saklamak, görüntülemek ve paylaşmak üzere Sotu'ya münhasır olmayan, dünya çapında, telifsiz bir lisans verirsin.

Herkese açık yaptığın İçerik — herkese açık yollar, herkese açık sürüşler, yol hikayeleri, puanlar ve paylaşımlar — diğer Sotu kullanıcılarına ve internetteki herkese görünür: paylaşılan yol sayfaları (sotuapp.com/r/…), herkese açık sürüş sayfaları (sotuapp.com/ride/…) ve kulüp davet sayfaları (sotuapp.com/invite/…) hesap olmadan görüntülenebilir.

5. Kabul edilebilir kullanım

Diğer kullanıcıları taciz etme, tehdit etme ya da kötü davranma; hukuka aykırı, nefret içeren veya cinsel içerikli paylaşım yapma; Hizmet'i kazıma, tersine mühendislik uygulama ya da aşırı yükleme; paylaşma hakkına sahip olmadığın içeriği yükleme.

Sotu, rahatsız edici içerik ve kötü niyetli davranışa karşı sıfır tolerans uygular. Şikayet edilen ve bu Koşulları ihlal ettiği görülen içerik kaldırılır; ihlali tekrarlayan kullanıcıların hesapları kapatılır. Uygulamada ilgili öğenin menüsünden ya da hello@sotuapp.com adresine yazarak şikayet edebilirsin; her şikayeti bir insan inceler.

Özel mesajlar ve kulüp sohbetleri önceden denetlenmez.

6. Engelleme ve şikayet

Uygulamada herhangi bir kullanıcıyı engelleyebilir, herhangi bir içeriği şikayet edebilirsin. Engelleme, seninle engellediğin kullanıcıyı birbirinizden gizler. Her şikayeti 24 saat içinde bir insan inceler ve bu Koşulları ihlal eden her şeyi kaldırır; ihlali tekrarlayan hesap askıya alınır ya da kapatılır. Şikayet ettiğin bir yorum ya da sohbet mesajı, incelenirken senden hemen gizlenir.

7. Telif hakkı ve diğer şikayetler

Sotu'daki bir içerik telif hakkını ihlal ediyor, markanı kullanıyor, seni taklit ediyor ya da haklarını başka bir şekilde çiğniyorsa hello@sotuapp.com adresine bağlantıyı (ya da ekran görüntüsünü), içeriğin ne olduğunu ve talebinin dayanağını yaz. İhlal eden içeriği vakit kaybetmeden kaldırır ve ne yaptığımızı sana bildiririz. 5651 sayılı Kanun kapsamındaki bildirimler ve DMCA benzeri bildirimler de aynı adrese ulaşır.

8. Sona erme

Hesabını dilediğin zaman uygulamadan silebilirsin (Sen › Ayarlar › Hesabı Sil). Silme işlemi, Gizlilik Politikası'nda anlatıldığı gibi hesabını ve ilgili kişisel verilerini kalıcı olarak kaldırır. Sotu, bu Koşulları ihlal eden hesapları askıya alabilir ya da kapatabilir.

9. Sotu Plus

Sotu'yu kullanmak ücretsizdir. Sotu Plus, uygulamada daha fazla özelliği açan isteğe bağlı, ücretli bir yükseltmedir. Neyin ücretsiz olduğu ve Plus'a nelerin dahil olduğu, satın almadan önce uygulamada ve sotuapp.com/plus adresinde listelenir.

• Apple üzerinden satın alınır. Sotu Plus yalnızca App Store'da uygulama içi satın alma olarak satılır ve Apple Kimliğine faturalandırılır. App Store, onaylamadan önce fiyatı kendi para biriminde gösterir; ödemeyi ve vergileri Apple yönetir.
• Abonelikler kendiliğinden yenilenir. Aylık ve yıllık planlar, dönem bitmeden en az 24 saat önce iptal etmezsen her dönemin sonunda o günkü fiyattan yenilenir. Ayarlar › Sotu Plus'tan ya da Apple Kimliğinin abonelik ayarlarından istediğin zaman iptal edebilirsin; ödediğin dönemin sonuna kadar Plus sende kalır.
• Ücretsiz deneme. Yıllık plan ücretsiz denemeyle sunulduğunda deneme bitene kadar hiçbir ücret alınmaz; deneme bitmeden en az 24 saat önce iptal etmezsen abonelik kendiliğinden başlar. Kimin uygun olduğuna Apple karar verir; deneme her Apple Kimliği için bir kez sunulur.
• Founding Rider bir abonelik değil, tek seferlik bir satın almadır. Sotu Hizmet'i işlettiği sürece her Plus özelliğini içerir ve satışta olduğu sırada gösterilen koltuk sayısıyla sınırlıdır.
• İadeler Apple tarafından, Apple'ın politikalarına göre yapılır (reportaproblem.apple.com); Sotu doğrudan iade yapamaz. Bir satın alma iade edildiğinde, sağladığı Plus erişimi sona erer.
• Fiyat değişiklikleri. Bir aboneliğin fiyatı değişirse Apple seni önceden bilgilendirir ve yasaların ya da Apple kurallarının gerektirdiği durumlarda yeni fiyat uygulanmadan önce onayını ister.
• Plus'a dahil olanlar Hizmet geliştikçe değişebilir; değişiklikler yürürlüğe girmeden önce uygulamada duyurulur. Kayıt ücretsiz kalır, kaydettiğin her sürüş saklanır ve verilerini Plus olsun olmasın her zaman dışa aktarabilirsin.
• Sotu hesabını silmek App Store aboneliğini iptal etmez — aboneliği Apple Kimliği ayarlarından da iptal et.

10. Feragat ve sorumluluğun sınırlandırılması

Hizmet, açık ya da örtülü hiçbir garanti verilmeksizin "olduğu gibi" ve "mevcut olduğu şekliyle" sunulur. Yasaların izin verdiği en geniş ölçüde Sotu'nun Hizmet'ten doğan ya da Hizmet'le ilgili herhangi bir talep için toplam sorumluluğu, talebe yol açan olaydan önceki on iki ay içinde Sotu Plus için ödediğin tutarla sınırlıdır. Bu Koşullardaki hiçbir hüküm, yasanın hariç tutulmasına ya da sınırlandırılmasına izin vermediği bir sorumluluğu hariç tutmaz ya da sınırlandırmaz.

11. Uygulanacak hukuk

Bu Koşullar, kanunlar ihtilafı kuralları hariç olmak üzere Türkiye Cumhuriyeti hukukuna tabidir. İkamet ettiğin ülkenin emredici tüketici koruma kuralları saklıdır.

12. Değişiklikler

Bu Koşullar, Hizmet geliştikçe güncellenebilir. Önemli değişiklikler uygulamada ya da bu sayfada duyurulur; yukarıdaki "Son güncelleme" tarihi her zaman geçerli sürümü gösterir. Değişiklikten sonra kullanmaya devam etmen, güncel Koşulları kabul ettiğin anlamına gelir.
